Eviction Sealing
Georgia New Eviction Record Restriction Law
New protections for Georgia renters take effect January 1, 2027.
Georgia’s Senate Bill 406 (Act 715) creates a new process allowing eligible tenants to ask a court to restrict public access to certain eviction records.
Under the new law, tenants may qualify if they won their eviction case, paid a judgment in full, or meet certain requirements after seven years. Record restriction is not automatic; tenants must file a motion, and the court must hold a hearing.
Eviction records can create significant barriers to securing housing, even when a tenant was not ultimately evicted. This new protection offers an important opportunity to reduce those barriers for Georgia families.
The Georgia Healthy Housing Coalition, convened by Georgia Appleseed, has developed a one-page resource explaining the new law, eligibility requirements, and why eviction record restrictions matter.
